Chapter 7 Bankruptcy

Sypher Law Firm, LLC, has the experience to assist you in meeting all the requirements of the Bankruptcy Code in order to maintain your credit standing. The firm realizes that life-changing events like job loss, divorce, or medical debt can snowball into a need to file for chapter 7 bankruptcy.

In a chapter 7 bankruptcy case, the court appoints a bankruptcy "trustee." If appropriate, the trustee may gather and sell your nonexempt assets and use the proceeds of the sales to pay creditors. Part of your property may be subject to liens and mortgages held by creditors. The Bankruptcy Code will allow you to keep certain "exempt" property, but a trustee may liquidate your remaining assets. Accordingly, you should realize that the filing of a petition under chapter 7 bankruptcy may result in the loss of property.

Chapter 7 Eligibility

To qualify for debt relief under Chapter 7 of the Bankruptcy Code, you may be an individual, a partnership, or a corporation or other business entity. Subject to a bankruptcy means test, which determines your income, expenses, property owned, and the ability to pay your debts, relief is available under chapter 7, regardless of the amount of your debt or whether you are solvent or insolvent.
