Kansas City Bankruptcy Attorney
Divorce is one of the leading causes of bankruptcy. Each spouse usually goes from two incomes to living on one income. A requirement to provide child support can put additional burdens on one of the parents. If you are thinking about getting a divorce and have a large amount of unmanageable joint debts with your spouse, you should strongly consider a bankruptcy filing before you divorce. This may save you money and countless headaches down the line.
Sypher Law Group, L.L.C. is an experienced bankruptcy law firm. We can advise you as to your best course of action. Call 913-451-8833 or send us an e-mail for a free consultation.
Before Your Divorce
A common mistake is dividing up joint debt in a divorce decree. One thing to remember is that a divorce decree is a private contract between the two divorcing parties and has no legal effect on your creditors. This means, that if your ex-spouse promised to pay debt pursuant to your divorce and stops paying it, the creditor can come after you for payment, if you were originally obligated on the loan. This includes mortgages and car loans, as well as credit cards and medical bills. A Chapter 7 bankruptcy, which discharges your unsecured debt, is a good way to avoid this problem after a divorce. If you and your spouse can work together to complete a Chapter 7 case prior to completing your divorce, the divorce process will go much smoother.
Of course, there are exceptions to this and you should speak with a bankruptcy attorney to discuss your options.
At Sypher Law Group, L.L.C., we have helped many people in this situation. We can file for bankruptcy on your behalf before your divorce, to minimize the possibility of any adverse consequences.
If You Are Already Divorced
Bankruptcy situations in which the parties are already divorced and retain jointly held debts are more complicated, but debt relief through bankruptcy is still possible. In this situation, each party needs his or her own lawyer. Sypher Law Group, L.L.C. has worked successfully with other lawyers in these types of circumstances.
