One thing to remember is that a divorce decree is a private contract between the two divorcing parties and has no legal effect on your creditors. This means, that if your ex-spouse promised to pay debt pursuant to your divorce and stops paying it, the creditor can come after you for payment, if you were originally obligated on the loan. This includes mortgages and car loans, as well as credit cards and medical bills. A Chapter 7 bankruptcy, which discharges your unsecured debt, is a good way to avoid this problem after a divorce. If you and your spouse can work together to complete a Chapter 7 case prior to completing your divorce, the divorce process will go much smoother.
